Copyright Complaints / Takedown Guide
These guidelines explain how to report alleged copyright infringement for content hosted in Wallfinity and how we handle those reports. Related documents: Copyright Policy and Terms of Service.
1. About our role
Wallfinity functions as a hosting platform for user-submitted wallpapers. We provide infrastructure for users to upload, store, browse, and download images. We do not necessarily manually review or clear every submission for originality before it appears in the app, and we do not guarantee that every wallpaper is non-infringing.
Rights holders may request that we review and, where appropriate, remove or disable access to specific content. We review each case. This guide describes our intake process; it does not constitute legal advice and does not replace rights available under applicable law.
2. How to submit a complaint
Email a written notice to haxcorporation@gmail.com with the subject line “Wallfinity Copyright Complaint”. You may also copy hello@wallfinity.app.
Your complaint should include as much of the following as possible:
- Your full name, mailing address, telephone number, and email address
- A description of the copyrighted work you claim has been infringed (and, if available, a URL or other location of an authorized version)
- Enough detail for us to locate the material in Wallfinity (for example wallpaper title, category, contributor nickname, screenshot, direct link, or other identifying information)
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury that you are the copyright owner or authorized to act on the owner’s behalf
- Your physical or electronic signature
Incomplete notices may delay review or be declined until we receive the missing information.
3. What happens after you file
- We acknowledge receipt when practicable and conduct a preliminary review.
- If the report appears valid and the content can be identified, we may temporarily disable, remove, or restrict access to the reported material while we complete review.
- Where we can identify the uploader, we may notify them that a complaint was received.
- We may ask you or the uploader for additional documentation or clarification.
Filing a complaint does not guarantee removal. We may reject complaints that are incomplete, fraudulent, unsupported, or outside what we can reasonably act on.
4. Counter-notification
If your content was removed or disabled because of a complaint and you believe the removal was mistaken or that you are authorized to use the material, you may send a counter-notification to the same email addresses within a reasonable time (we typically look for a response within about 10 days of notice).
A counter-notification should include:
- Your name, address, phone number, and email
- Identification of the material that was removed and where it appeared
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
- Consent to the jurisdiction of an appropriate court and acceptance of service of process from the complainant (where required by applicable law)
- Your physical or electronic signature
If we receive a valid counter-notification, we may reinstate the content unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement. We are not obligated to mediate ownership disputes beyond what applicable law requires.
5. Repeat infringers
We reserve the right to suspend or permanently disable access for users who repeatedly violate copyright law or these guidelines, at our sole discretion and in accordance with applicable law (including DMCA repeat-infringer expectations where they apply).
6. Important limitations
- Wallfinity does not act as your lawyer and will not mediate private disputes beyond the process described here.
- If a complaint cannot be resolved through this process, either party may pursue legal remedies independently.
- Misrepresenting infringement in a notice or counter-notice may expose you to liability under applicable law.
